Librarymall™ Terms and Conditions

Please read carefully the following Terms and Conditions that are applicable to any transaction that might occur now or in future between you and LibraryMall™. You are deemed to have read, understood and agreed to these Terms and Conditions, Privacy Statement and Disclaimer Notice in the case that you have browsed, used or registered with www.librarymall.com or availed any of the rental services provided by Librarymall™.

Please note that from here on in this document 'our', 'the company', 'we', 'us' refers to Librarymall™ and 'you', 'your', 'subscriber' or any other obvious variants of the same refers to you.

Librarymall™ reserves the right to modify, add or delete any of the below mentioned Terms and Conditions with or without prior notice to the subscribers. The current version of Terms and Conditions (the one that can be viewed by clicking on Terms and Conditions link in the site) is the only version for the moment and cannot be contested with the points in the previous versions.

We are committed to protect the privacy of our users and we guarantee you that the information provided by you will not be used or sold or misused by any third party not concerned with our company. Your information will only be used to contact you or to perform any other action related to your account by authorised personnel working for Librarymall/magazine(s) Services. We will investigate any actions that involve misuse of data with a view to prosecuting and/or taking civil proceedings to recover damages against those responsible.

You become a member with access to the various services offered by our company as soon as you provide enough details mentioned in your registration form available by clicking 'register' link. Being a member on www.librarymall.com does not automatically mean that you are obligated to pay the subscription charges. Your billing procedure will not begin until you have ordered your first set of books/magazines, referred to as ‘order' from here on. to oeder the books/magazines, You have to prepare wishlist/rental queue by adding items from Book/magazine section at the our website, for those who doesn’t have online access can select the items from catalogues and submit to Librarymall™ to perpare wishlist/rental queue.You must have add at least 30 items in your wishlist/rental queue. Company can recall the the book(s) after 7 days if ordered by other subscribers otherwise you can keep as long as you want.For magazine(s) you must have to submit on 5th working day.

As a subscriber to our services, you agree that you will be billed on utilization of any of our services namely renting, returning or using a book from the Librarymall™ . Your billing procedure will begin on the day you receive your first order. The same is applicable to credit, debit or online payment as well. The amount you will be billed with depends on the subscription package namely monthly, quarterly or annual that you have chosen while registering or through your My Account page. You will be billed for every month you are in possession of a book and you will not be billed for the months you did not rent any book. Your subscription will be extended to another month if you did not return a book in your subscription period. If your subscription begins on a date that is not available in the following month, your month will end at the last date of the following month.For example if your subscription began on August 31st, your monthly period for subscription will end at September 30th.Under no condition will cash refund happen.

If you return your books in the given subscription period, you will not be obligated to extend your subscription period. As long as you are in the possession of a book, you will have to pay the monthly subscription amount. Alternatively, you can renew your subscription period by ordering more books or by clicking the 'renew' button in your account page. Your next subscription period will begin as soon as you receive a delivery of books at your place.

You are responsible for the upkeep of the books you receive. Any damages or misplacement of the book results in billing you with the market price of the book plus Rs. 100/- as administration charges. Librarymall™ reserves the right to judge the extent of damage imposed on the book.

For cancellation process you need to call our customer care on +9120-65103077/78 and place a cancellation request to our representative, on cancellation you required to submit the books/magazines within 7 days, failure to same results in being billed for such items.

Librarymall™ does not provide any warranties for the services or content provided in the website. The rules and regulations, policies, terms of service or prices may change anytime and the subscriber may or may not be informed about them. Librarymall™ does not assume any responsibility or libility for any failures, delays, or interruptions in the shipment of book(s), delivery of any content contained on the Librarymall™ Website, any losses or damages arising from the use of the content provided on the Librarymall™ Website, or any conduct by users of the Librarymall™ or Website. We reserve the right to ship book(s) in our sole and absolute discretion, though as responsibly as possible. We disclaim all representations and warranties, including, for example, warranties of merchantability, fitness for a particular purpose, and non-infringement. In addition, we do not represent or warrant that the information accessible via our site is accurate, complete or current. The information on this web site is provided on an "as is" basis. To the fullest extent permitted by law, this Company:

excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the Company's literature; and

excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised this Company of the possibility of such potential loss), damage caused to your computer, computer software, systems S and programs and the data thereon or any other direct or indirect, consequential and incidental damages.

This Company does not however exclude liability for death or personal injury caused by its negligence. The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.
